Terms of Service

These Terms of Service ("Terms") govern your use of aspenmediagroup.ca (the "Site") and the services provided by Aspen Media Group ("Aspen Media Group", "AMG", "we", "us", or "our"), a real estate media company based in Calgary, Alberta, Canada. By using this Site or engaging our services, you agree to these Terms.

Our services

AMG provides real estate photography, videography, social media content, iGuide 3D virtual tours, and RMS measurements for real estate professionals, primarily in Calgary and the surrounding area. The specific deliverables, schedule, pricing, and payment terms for any engagement are set out in your booking confirmation or invoice, which, together with these Terms, form the agreement between us.

Bookings, scheduling, and payment

• A booking is confirmed once a shoot is scheduled and, where applicable, any required deposit or agreement is in place.
• Pricing, deposits, payment timing, rescheduling, and cancellation terms are those stated in your booking confirmation or invoice.
• The client is responsible for ensuring the property is accessible and in shoot-ready condition on the scheduled date. Delays or re-shoots caused by property readiness or access may affect timelines and fees.

Intellectual property and content licence

• AMG retains copyright and ownership of all photographs, video, and other content we create.
• Upon full payment, the client (the listing agent or brokerage engaging us) receives a non-exclusive, non-transferable licence to use the delivered media to market the specific property and the client's personal real estate brand — including on MLS, Realtor.ca, social media, websites, and advertising.
• The media may not be resold, sublicensed, or redistributed to third parties, and may not be used by other agents or brokerages, without AMG's prior written permission. Material alterations to the work require our consent.
• Unless agreed otherwise in writing, AMG may display the media in our own portfolio and marketing.

Acceptable use of the Site

You agree not to misuse the Site, interfere with its operation, or use it for any unlawful purpose. All content on the Site is owned by or licensed to AMG and may not be copied or reused without permission.

Third-party services

The Site and our deliverables may link to or rely on third-party services (for example, iGuide tours or social media platforms). We are not responsible for the content, policies, or practices of those third parties.

Disclaimers

The Site and our services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, AMG disclaims all implied warranties, including merchantability and fitness for a particular purpose.

Limitation of liability

To the fullest extent permitted by law, AMG's total liability for any claim arising out of or relating to our services or this Site will not exceed the amount paid for the specific engagement giving rise to the claim. AMG will not be liable for any indirect, incidental, or consequential damages.

Governing law

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein. You agree that any dispute will be subject to the exclusive jurisdiction of the courts of Alberta.

Changes to these Terms

We may update these Terms from time to time. The "last updated" date above reflects the most recent revision. Your continued use of the Site or our services after changes are posted constitutes acceptance of the updated Terms.
